Credit: HOSHANG HASHIMI \/ AFP<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row column_structure=&#8221;3_4,1_4&#8243; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221;][et_pb_column type=&#8221;3_4&#8243; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221;][et_pb_text _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221; custom_padding=&#8221;||0px|||&#8221;]<\/p>\n<p><span style=\"font-weight: 400;\">South Asia presents a uniformly discouraging picture in terms of media freedom as\u00a0 governments across the region, increasingly made use of the law to clampdown on the independent media and censored journalists for their news reports and activists and citizens for their views in digital spaces and on social media.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Covid-19 pandemic and the resultant stringent lockdowns saw journalists working against stiff odds and at great personal risk, with little or no support or safety equipment. Journalists who reported on hardships caused to people because of restrictions on movement and curbed access to essential commodities and services were met with the heavy hand of the law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In order to delegitimise journalists and crush their morale, their reporting was termed fake news. Accusations of misinformation became a <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/06\/08\/uttar-pradesh-fatehpurs-journalists-stand-in-the-ganga-to-protest-against-harassment-by-administration\"><span style=\"font-weight: 400;\">common pretext<\/span><\/a><span style=\"font-weight: 400;\"> on which to book journalists or send them legal notices.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2020-21, a variety of tactics were used to stifle the freedom of expression of journalists and restrict their work. <\/span><span style=\"font-weight: 400;\">Journalists, particularly those critical of the government, were subjected to a wide spectrum of laws and action by law enforcement agencies. In many cases, the process itself is the punishment, due to lengthy and harrowing legal procedures, expenses involved and denial of bail, affecting a journalists\u2019 right to work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Across South Asia, these twin tactics \u2013 penalising journalists or debunking verified news as fake \u2013 resulted in repression, censorship and intimidation and delegitimised attempts by the media to hold governments to account. Reports of the lockdown and resultant disruption in the lives of scores of people, loss of livelihoods, destitution and the extreme vulnerability of citizens across South Asia due to the collapse of public health systems were sought to be criminalised and silenced. Along with lack of transparency by government, there was an increasing tendency to centralise information and block access to means of independent verification, thus making it harder for the media to do its job of informing the public during a time when accurate data and information were crucial.<\/span><\/p>\n<p><b>Afghanistan<\/b><span style=\"font-weight: 400;\"> continued to be exceedingly dangerous for journalists who faced threats from government, security forces and armed extremist groups. The impunity with which women journalists and other media workers were killed by the Taliban and the Daesh (IS) (six between September 2020 and January 2021) only underscores how precarious journalism is, especially with the scheduled US troop withdrawal from the country.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Press laws in Afghanistan <\/span><span style=\"font-weight: 400;\">mandate that the Commission for the Verification of Press Offences deals with complaints against media and journalists after which they are transferred to appropriate courts. Despite this legal protection, agents of the National Department of Security (NDS) arrested two journalists, <\/span><b>Mahboboalah Hakimi <\/b><span style=\"font-weight: 400;\">of <\/span><i><span style=\"font-weight: 400;\">Radio Bayan<\/span><\/i><span style=\"font-weight: 400;\"> (Word), for allegedly insulting the president in a Facebook post. The home of <\/span><b>Farough Jan Mangol,<\/b><span style=\"font-weight: 400;\"> the <\/span><i><span style=\"font-weight: 400;\">Reuters<\/span><\/i><span style=\"font-weight: 400;\"> news agency\u2019s correspondent in Khost was searched without a warrant and the <\/span><a href=\"https:\/\/rsf.org\/en\/news\/two-afghan-journalists-arrested-news-agency-harassed\"><span style=\"font-weight: 400;\">NDS<\/span><\/a><span style=\"font-weight: 400;\"> later said it was a mistake.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Covid-19 pandemic worsened the situation and journalists found it difficult to access information on those affected and measures to deal with the public health crisis. <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><b>Danish Karokhel<\/b><span style=\"font-weight: 400;\">, the director of Afghanistan\u2019s biggest news agency, <\/span><a href=\"https:\/\/rsf.org\/en\/news\/coronavirus-information-heroes-journalism-saves-lives\"><span style=\"font-weight: 400;\">Pajhwok Afghan News<\/span><\/a><span style=\"font-weight: 400;\">, was subjected to intense questioning and harassment after the agency reported that <\/span><a href=\"https:\/\/www.pajhwok.com\/en\/2020\/06\/22\/ventilators-donated-moph-smuggled-pakistan?utm_source=dlvr.it&amp;utm_medium=twitter\"><span style=\"font-weight: 400;\">32 ventilators intended for Afghan coronavirus patients had been<\/span> <span style=\"font-weight: 400;\">stolen and sold to Pakistan<\/span><\/a><span style=\"font-weight: 400;\">. The agency was accused of acting against national security.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government in Afghanistan proposed several amendments to the Mass Media Law 2006, meant to drastically curtail the freedom of press. In an open letter to President<\/span><b> Ashraf Ghani <\/b><span style=\"font-weight: 400;\">media houses in Afghanistan said that the <\/span><span style=\"font-weight: 400;\">proposed amendments are in contravention of Articles 7, 34, 120 and 122 of Afghanistan\u2019s Constitution.<\/span> <a href=\"https:\/\/www.jurist.org\/news\/2020\/06\/afghanistan-government-withdraws-controversial-media-law-amendment\/\"><span style=\"font-weight: 400;\">The amendments<\/span><\/a><span style=\"font-weight: 400;\"> included increasing the authority of government\u2019s monitoring organisations, reducing the rights of media companies and journalists, reducing the independence of national television, allowing government censorship before and after publication &#8211; and most controversially- requiring journalists to <\/span><a href=\"https:\/\/www.aljazeera.com\/news\/2020\/6\/25\/afghan-media-reject-new-rules-they-say-could-hurt-press-freedom\"><span style=\"font-weight: 400;\">reveal their sources<\/span><\/a><span style=\"font-weight: 400;\"> to government bodies including the security services. The amendments were <\/span><a href=\"https:\/\/www.outlookindia.com\/newsscroll\/ghani-recalls-draft-of-amendments-to-media-law\/1874611\"><span style=\"font-weight: 400;\">withdrawn<\/span><\/a><span style=\"font-weight: 400;\"> after widespread protest.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the 14<\/span><span style=\"font-weight: 400;\">th<\/span> <a href=\"https:\/\/www.ajsc.af\/wp-content\/uploads\/2021\/02\/AJCS-Annual-Reports-2020-English.pdf\"><span style=\"font-weight: 400;\">report<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><span style=\"font-weight: 400;\">Afghan Journalists Safety Committee (AJSC), <\/span><span style=\"font-weight: 400;\">the <\/span><span style=\"font-weight: 400;\">\u201cdramatically increased levels of direct attacks and assassinations of journalists at the end of 2020 has created widespread panic among media outlets and journalists across Afghanistan. These attacks have had a noticeably adverse effect on impartial and objective reporting, with many journalists admitting to reconsidering both how and whether to report on certain topics for fear of reprisal &#8211; effectively amounting to the increasingly widespread practice of self-censorship. Additionally, the economic impact of Covid-19 has compounded existing financial challenges for media outlets, often frustrating their efforts to raise sufficient funds, and thereby their capacity to generate media content.\u201d<\/span><\/p>\n<p><b>Bangladesh<\/b><span style=\"font-weight: 400;\"> continues to deal with media critics under the now notorious <\/span><a href=\"https:\/\/www.hrw.org\/news\/2019\/07\/19\/bangladeshs-draconian-internet-law-treats-peaceful-critics-criminals\"><span style=\"font-weight: 400;\">Digital Security Act 2018<\/span><\/a><span style=\"font-weight: 400;\">. The death in police custody of blogger Mushtaq Ahmed in February 2021 once more shone the spotlight on this broad ranging draconian law. Along with cartoonist Ahmed Kabir Kishore, Mushtaq Ahmed had been under the DSA for allegedly spreading rumours and misinformation about the pandemic. Kabir Kishore who, like Mushtaq Ahmed had been denied bail for ten months, was finally released on bail on March 4, eight days after the death of blogger Mushtaq Ahmed. <\/span><span style=\"font-weight: 400;\">(For more on the DSA see chapter xxx).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legal environment for journalists in Bangladesh is also circumscribed by poorly defined defamation laws which are arbitrarily implemented. For instance, magistrates permit unrelated third parties to bring defamation cases on behalf of someone ostensibly injured, leading to a serious chilling effect on freedom of expression.<\/span><\/p>\n<p><b>In Bhutan,<\/b><span style=\"font-weight: 400;\"> while the Constitution guarantees the right to freedom of speech, opinion and expression, a recent notification issued by the Thimpu Thrombde (administrative division) <\/span><span style=\"font-weight: 400;\">established a protocol mandating media professionals to seek written permission to avail information. The Thromde issued a notification on 12 April 2021, asking any individual or media person wanting to avail information to fill up a form and wait for the response\u00a0from the media relations officer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The president of Journalist Association of Bhutan, Rinzin Wangchuk, said the Thromde\u2019s new protocol comes at a time when journalists in the country are already facing challenges in access to information. He said such requirements will further hinder journalists from carrying out their duties of informing the people. \u201cIt will cause a delay in the\u00a0dissemination of information to the public.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An <\/span><a href=\"https:\/\/kuenselonline.com\/democracy-needs-opinions-and-debates\/\"><span style=\"font-weight: 400;\">editorial<\/span><\/a><span style=\"font-weight: 400;\"> in Bhutan\u2019s largest circulated English daily <\/span><i><span style=\"font-weight: 400;\">Kuensel<\/span><\/i><span style=\"font-weight: 400;\"> called upon the revocation of this rule, stating that this was not the first time the bureaucracy was trying to disrupt relations between the media, the government and public officials.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Lawyer Sonam Tshering in his <\/span><a href=\"https:\/\/kuenselonline.com\/thimphu-thromde-gags-the-fundamental-freedoms-of-media-and-citizens\/\"><span style=\"font-weight: 400;\">article<\/span><\/a> <span style=\"font-weight: 400;\">said<\/span> <span style=\"font-weight: 400;\">Thimphu Thromde\u2019s notification on how to request information from them is nothing short of an authoritarian attitude that undermines the fundamental freedoms of both media and individuals seeking information and threatens the foundations of democracy<\/span><span style=\"font-weight: 400;\">. It is unprecedented in the history of Bhutan\u2019s democracy where local government \u2013which is expected to be the closest democratic government to the electorate \u2013 has decided to restrain the right to information including the right to reject and discretion to change the existing form without notice.\u00a0<\/span><\/p>\n<p><b>In India,<\/b><span style=\"font-weight: 400;\"> both central and state governments were watchful of social media coverage of their actions, schemes and policies and arbitrarily punished journalists for a mere tweet or Facebook post.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2020 alone, 67 journalists in India <\/span><span style=\"font-weight: 400;\">were &#8220;arrested, detained, interrogated or served show cause notices for their professional work&#8221;, according to a <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/12\/24\/154-journalists-in-india-arrested-interrogated-in-past-decade-67-cases-in-2020-alone-free-speech-collective\"><span style=\"font-weight: 400;\">Free Speech Collective<\/span><\/a><span style=\"font-weight: 400;\"> report. <\/span><span style=\"font-weight: 400;\">The journalists primarily worked for non-English media houses, were freelancers or worked for digital media.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Journalists were booked under a dizzying variety of laws &#8211; <\/span><span style=\"font-weight: 400;\">ranging from the Unlawful Activities Prevention Act, 1967 (UAPA) Information Technology Act,2000 (IT Act) Disaster Management Act, 2005 (NDMA) and the 124-year-old colonial era Epidemic Diseases Act, 1897.\u00a0 Involvement of higher law enforcement agencies like the Enforcement Directorate (ED) and National Investigative Agency (NIA) were also part of the government\u2019s legal arsenal to intimidate journalists and media houses.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As in previous years, various sections of the Indian Penal Code (IPC) sections were used by the police to browbeat journalists. <\/span><span style=\"font-weight: 400;\">Journalists were booked for \u2018fake news\u2019 under the <\/span><a href=\"https:\/\/indianexpress.com\/article\/cities\/lucknow\/kanpur-dehat-3-journalists-booked-over-fake-news-7164585\/\"><span style=\"font-weight: 400;\">IPC \u00a0sections 505<\/span><\/a> <span style=\"font-weight: 400;\">(statements likely to create public alarm or likely to incite the public<\/span><span style=\"font-weight: 400;\">) and 506 <\/span><span style=\"font-weight: 400;\">(criminal intimidation) for public mischief and criminal intimidation.<\/span><span style=\"font-weight: 400;\"> The sedition law was also applied widely. Section 124A of the IPC- is a <\/span><a href=\"https:\/\/www.indiatoday.in\/education-today\/gk-current-affairs\/story\/use-and-misuse-of-sedition-law-section-124a-of-ipc-divd-1607533-2019-10-09\"><span style=\"font-weight: 400;\">major sedition law<\/span><\/a> <span style=\"font-weight: 400;\">which punishes invoking hatred or disaffection against the government. A non-bailable offence, it carries both imprisonment and fine.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government\u2019s frequent and unrelenting use of sedition laws prompted the IFJ and the International Press Institute to write a letter to Prime Minister Narendra Modi, which <\/span><a href=\"https:\/\/indianexpress.com\/article\/india\/harassment-of-journalists-global-press-bodies-write-to-pm-modi-6826220\/\"><span style=\"font-weight: 400;\">said<\/span><\/a><span style=\"font-weight: 400;\">: \u201cThe use of sedition laws to harass independent, critical journalists is not only a gross violation of the country\u2019s international commitments, it is also an attempt by the government to silence any criticism. Journalistic work cannot be equated to sedition or undermining security.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The letter also observed that the 2020 pandemic and ensuing health crisis \u201cis being used as an excuse to silence those who have exposed shortcoming in the government\u2019s response to it\u2026\u201d\u00a0 <\/span><span style=\"font-weight: 400;\">Indeed, the government took ample advantage of periods of disturbance and unrest in the country to stifle the voices of dissenting journalists. Spikes in legal action against journalists were evident where journalism was related to effects of the pandemic and the government\u2019s handling of it, the Hathras gangrape and the farmer\u2019s protests.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another tactic was to delegitimise journalists by denying their professional identity. For instance, magistrates permit unrelated third parties to bring defamation cases on behalf of someone ostensibly injured, leading to a serious chilling effect on freedom of expression.<\/span><\/h3>\n<p>[\/et_pb_blurb][et_pb_divider show_divider=&#8221;off&#8221; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;||223px|||&#8221;][\/et_pb_divider][et_pb_blurb admin_label=&#8221;Blurb&#8221; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;-3px||-14px|-25px||&#8221; animation_style=&#8221;fade&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/samsn.ifj.org\/SAPFR20-21\/wp-content\/uploads\/2021\/04\/Artboard-2-e1619419378127.png\" width=\"60\" height=\"56\" alt=\"\" class=\"wp-image-920 alignnone size-full\" \/><\/p>\n<h3><span style=\"color: #ff0000;\">Journalists were booked for \u2018fake news\u2019 under the <a href=\"https:\/\/indianexpress.com\/article\/cities\/lucknow\/kanpur-dehat-3-journalists-booked-over-fake-news-7164585\/\">IPC sections 505<\/a> (statements likely to create public alarm or likely to incite the public) and 506 (criminal intimidation) for public mischief and criminal intimidation.<\/span><\/h3>\n<p>[\/et_pb_blurb][\/et_pb_column][\/et_pb_row][et_pb_row column_structure=&#8221;3_4,1_4&#8243; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221; custom_margin=&#8221;43px|auto|12px|auto|false|false&#8221; custom_padding=&#8221;9px|||||&#8221;][et_pb_column type=&#8221;3_4&#8243; _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221;][et_pb_text _builder_version=&#8221;4.9.4&#8243; _module_preset=&#8221;default&#8221;]<\/p>\n<h3>Pandemic and lockdown<\/h3>\n<p><span style=\"font-weight: 400;\">Wherever journalists exposed negligence and apathy by the administration \u2013 whether with regard to challenges faced by healthcare workers, questioning quarantine policies, reporting on the poor quality of PPEs, deaths due to hunger and migrant workers not getting rations &#8211;\u00a0 they had to face consequences.<\/span><span style=\"font-weight: 400;\"> For example, executive editor at Scroll.in, Supriya Sharma, who published a report about how people in a village adopted by the Prime Minister went hungry during the lockdown, was <\/span><a href=\"https:\/\/thewire.in\/media\/supriya-sharma-fir-abuse-law-press-freedom\"><span style=\"font-weight: 400;\">charged<\/span><\/a><span style=\"font-weight: 400;\"> under various sections of the IPC, including defamation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/05\/07\/gagging-the-media-a-list-of-indian-journalists-booked-arrested-assaulted-during-the-lockdown\"><span style=\"font-weight: 400;\">report by Newslaundry<\/span><\/a><span style=\"font-weight: 400;\"> noted that a number of journalists were prevented from doing their work since the nationwide lockdown of March 2020. The journalists were impeded from working through \u201cpolice interrogation, notices, detention, FIR, arrest and assault\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Journalists were booked under IPC Section 188, related to disobeying a public servant\u2019s order, and Section 505 (1)(b), which punishes any action causing fear and alarm to the public, inducing individuals to commit an offence against the state.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Journalists also <\/span><a href=\"https:\/\/indianexpress.com\/article\/india\/14-firs-five-reporters-himachal-fake-news-disaster-management-act-6412057\/\"><span style=\"font-weight: 400;\">faced charges<\/span><\/a><span style=\"font-weight: 400;\"> under the National Disaster Management Act, sections of which penalise individuals for spreading false alarms.\u00a0 The Epidemic Diseases Act, 1897 also became a common tool to impede journalists. This British era law empowers the state to take special measures to prevent the outbreak of dangerous epidemic diseases. It has been <\/span><a href=\"https:\/\/indianexpress.com\/article\/opinion\/editorials\/edpidemic-diseases-act-coronavirus-covid-19-india-lockdown-6419880\/\"><span style=\"font-weight: 400;\">used against<\/span><\/a><span style=\"font-weight: 400;\"> patients, journalists and Opposition leaders <\/span><a href=\"https:\/\/www.hindustantimes.com\/india-news\/about-500-cases-lodged-in-india-for-social-media-posts-on-covid-19\/story-PBaxt7oNs9IdPNUCVRiUUM.html\"><span style=\"font-weight: 400;\">across the country<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">India\u2019s Information Technology Act was also used to target journalists. <\/span><span style=\"font-weight: 400;\">Journalists from various parts of the country such as Himachal Pradesh, Tamil Nadu, Chhattisgarh, Andaman and Nicobar Islands, Bihar and Maharashtra were booked for critical reporting around government handling of the pandemic.<\/span><span style=\"font-weight: 400;\"> In <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/09\/15\/tripura-journalist-attacked-after-criticising-cm-biplab-debs-threat-to-media\"><span style=\"font-weight: 400;\">Tripura<\/span><\/a><span style=\"font-weight: 400;\">, the state government issued a notice to a website which published negative reports about the administration\u2019s response to COVID while one journalist was assaulted.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/05\/07\/gagging-the-media-a-list-of-indian-journalists-booked-arrested-assaulted-during-the-lockdown\"><span style=\"font-weight: 400;\">Uttar Pradesh<\/span><\/a><span style=\"font-weight: 400;\"> government led the ranks in cracking down on questioning journalists.\u00a0 In general, <\/span><span style=\"font-weight: 400;\">journalists who reported <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/07\/07\/missing-from-headlines-how-the-adityanath-regime-is-going-after-local-journalists\"><span style=\"font-weight: 400;\">gaps and inadequacies<\/span><\/a><span style=\"font-weight: 400;\"> in government schemes in Uttar Pradesh \u2014 like the Swacchh Bharat Mission and gaps in access to education and food welfare \u2014received notices or were booked by the police. Various state officials such as District Magistrates, sub-divisional magistrates, members of the Uttar Pradesh Special Task Force and the UP Police were involved in hounding journalists.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<h3>Hathras gang rape<\/h3>\n<p><span style=\"font-weight: 400;\">The brutal gang rape of a Dalit teenager in Hathras district placed the spotlight on Uttar Pradesh for its troubling record of crimes and violence against women. The UP government tried its best to control media coverage of the incident and <\/span><a href=\"https:\/\/thewire.in\/government\/uttar-pradesh-hathras-protests-curfew-media\"><span style=\"font-weight: 400;\">banned the media<\/span><\/a> <span style=\"font-weight: 400;\">from entering the village where the crime was committed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Siddique Kappan a journalist who wrote for <\/span><a href=\"https:\/\/thewire.in\/media\/hathras-case-malayalam-journalist-siddique-kappan-booked-under-sedition-uapa\"><span style=\"font-weight: 400;\">Malayalam news organisations<\/span><\/a><span style=\"font-weight: 400;\"> was on his way to Hathras when he and three others were charged under the UAPA and the IT Act in October 2020. <\/span><span style=\"font-weight: 400;\">The FIR by the UP Police against them claimed that they were going to Hathras with an intention \u201cto breach the peace\u201d as part of a \u201cconspiracy\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Enforcement Directorate (ED) also got involved and <\/span><a href=\"https:\/\/indianexpress.com\/article\/india\/ed-files-charges-against-siddique-kappan-pfi-members-7184999\/\"><span style=\"font-weight: 400;\">filed a chargesheet<\/span><\/a> <a href=\"https:\/\/indianexpress.com\/article\/india\/ed-files-charges-against-siddique-kappan-pfi-members-7184999\/\"><span style=\"font-weight: 400;\">in 2021<\/span><\/a><span style=\"font-weight: 400;\"> against Kappan and others, <\/span><a href=\"https:\/\/scroll.in\/latest\/986673\/hathras-case-ed-files-money-laundering-chargesheet-against-journalist-siddique-kappan-four-others\"><span style=\"font-weight: 400;\">accusing them of money laundering<\/span><\/a><span style=\"font-weight: 400;\">. They were charged on grounds of their association with the Popular Front of India and its student wing the Campus Front of India (CFI), which according to the ED were involved in funding and participating in the protests against the Citizenship Amendment Act, the 2020 Delhi riots and protests against the Hathras gangrape.\u00a0<\/span><\/p>\n<h3>Farmer protests<\/h3>\n<p><span style=\"font-weight: 400;\">The introduction of new Farm Bills in September 2020 which brought thousands of farmers to the streets in protest, especially in North India, received wide coverage in the media. But many journalists who covered the protests also bore the brunt of police violence and legal action.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>\u00a0<span style=\"font-weight: 400;\">First information reports (FIRs) were filed by the police in Delhi, Madhya Pradesh and Uttar Pradesh against six journalists Rajdeep Sardesai, Mrinal Pande, Zafar Agha, Vinod Jose, Paresh Nath, and Anant Nath \u2013 and Congress politician Shashi Tharoor for <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/01\/29\/tractor-rally-shashi-tharoor-six-journalists-booked-for-sedition-in-up\"><span style=\"font-weight: 400;\">&#8220;misreporting&#8221;<\/span><\/a><span style=\"font-weight: 400;\"> on a Republic Day farmers rally. The FIRs were filed in connection with tweets by the journalists about the death of a protester during the rally. <\/span><span style=\"font-weight: 400;\">Most of the FIRs <\/span><a href=\"https:\/\/indianexpress.com\/article\/india\/sedition-firs-against-tharoor-journalists-now-in-five-states-7168390\/\"><span style=\"font-weight: 400;\">cited IPC sections<\/span><\/a> <span style=\"font-weight: 400;\">related to sedition, criminal intimidation, promoting enmity, provocation to break public peace, criminal conspiracy and outraging religious feelings. The journalists were also <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/01\/29\/tractor-rally-shashi-tharoor-six-journalists-booked-for-sedition-in-up\"><span style=\"font-weight: 400;\">booked<\/span><\/a> <span style=\"font-weight: 400;\">under the Information Technology Act. An FIR was also filed against an <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/01\/31\/two-firs-in-a-day-journalist-held-at-singhu-accused-of-assaulting-public-officials\"><span style=\"font-weight: 400;\">editor<\/span><\/a> <span style=\"font-weight: 400;\">who published an article questioning the events which led to the death of the protester. Kashmiri journalists are forced to regularly reckon with the might of the state, exercised through detention, raids, arbitrary slapping of the UAPA, physical assaults by the police and their reports repeatedly denounced as fake news.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the UAPA became a common tool to <\/span><span style=\"font-weight: 400;\">clamp down<\/span><span style=\"font-weight: 400;\"> on student leaders, activists and journalists across the country, in Kashmir, the UAPA was used by the government \u2018<\/span><a href=\"https:\/\/scroll.in\/article\/991077\/for-anything-and-everything-uapa-cases-are-rising-in-kashmir\"><span style=\"font-weight: 400;\">for anything and everything<\/span><\/a><span style=\"font-weight: 400;\">\u2019, whether protesters, academics or journalists.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">UAPA charges were pressed against 25 year old photojournalist <\/span><a href=\"https:\/\/www.newslaundry.com\/2020\/04\/24\/intimidation-is-in-the-air-how-the-indian-state-is-suffocating-kashmirs-journalists\"><span style=\"font-weight: 400;\">Masrat Zahra<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><i><span style=\"font-weight: 400;\">The Hindu<\/span><\/i><span style=\"font-weight: 400;\"> correspondent Peerzada\u00a0 Ashiq and the journalist Gowhar Geelani.\u00a0 Reporting against the army also invited FIRs. Two websites, <\/span><i><span style=\"font-weight: 400;\">The Kashmir Walla<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">The Kashmiriyat<\/span><\/i> <a href=\"https:\/\/scroll.in\/latest\/985579\/j-k-two-news-websites-booked-for-reports-on-army-forcing-shopian-school-to-celebrate-republic-day\"><span style=\"font-weight: 400;\">faced FIRs<\/span><\/a><span style=\"font-weight: 400;\"> for publishing reports which showed the Indian Army in an adverse light.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These clampdowns came when Kashmir was already reeling under the world\u2019s longest communication shutdown in the wake of the sudden revocation in August 2019 of Article 370 of India\u2019s Constitution that bestowed special status on the state of Jammu and Kashmir. After the restrictions on the media <\/span><a href=\"https:\/\/theprint.in\/india\/kashmir-times-is-latest-media-in-jk-has-been-gasping-for-breath-since-article-370-move\/527616\/\"><span style=\"font-weight: 400;\">became even more stringent<\/span><\/a><span style=\"font-weight: 400;\">. Following its downgrade from state to Union Territory, the Jammu and Kashmir government announced a <\/span><a href=\"https:\/\/www.epw.in\/engage\/article\/kashmir-media-policy-accentuating-curbs-freedom-press\"><span style=\"font-weight: 400;\">\u2018Media Policy 2020\u2019<\/span><\/a><span style=\"font-weight: 400;\"> which regulates advertising in media outlets, demands the thorough verification of the antecedents of each journalist and warns against fake news and anti-national activities.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In October 2020, the government authorities sealed the Srinagar office premises of <\/span><i><span style=\"font-weight: 400;\">The Kashmir Times<\/span><\/i><span style=\"font-weight: 400;\">, an English language newspaper.\u00a0 The executive editor, Anuradha Bhasin, termed it an act of vendetta for speaking out against the government and criticism for the <\/span><a href=\"https:\/\/scroll.in\/latest\/976230\/j-k-kashmir-times-office-in-srinagar-sealed-editor-vows-to-fight\"><span style=\"font-weight: 400;\">abrogation of Article 370<\/span><\/a><span style=\"font-weight: 400;\"> and media restrictions imposed on Kashmir.<\/span><span style=\"font-weight: 400;\"> In the <\/span><a href=\"https:\/\/theprint.in\/india\/attempt-to-muzzle-freedom-of-expression-jk-parties-journalists-condemn-nia-raids\/532720\/\"><span style=\"font-weight: 400;\">same month<\/span><\/a><span style=\"font-weight: 400;\">, the NIA conducted raids across the offices and homes of a number of journalists, writers and human rights activists. The Srinagar office of the newspaper <\/span><i><span style=\"font-weight: 400;\">Greater Kashmir<\/span><\/i><span style=\"font-weight: 400;\"> was also part of the raid, as were the residences of Khuram Parvez who is with the Jammu and Kashmir Coalition of Civil Society and Parveena Ahangar, the founder of the Association of Parents of Disappeared Persons. The raids point to the challenging environment in which journalists and human rights defenders function in Kashmir, their work constantly being subject to surveillance and suppression.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In another demonstration of the long arm of the law, the Enforcement Directorate raided the Delhi office of Newsclick, a digital news outlet and the homes of its editors on grounds of <\/span><a href=\"https:\/\/www.thehindu.com\/news\/national\/ed-conducts-searches-at-newsclick-office\/article33795253.ece\"><span style=\"font-weight: 400;\">alleged money laundering<\/span><\/a><span style=\"font-weight: 400;\">. The <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/02\/10\/bid-to-silence-critical-journalism-press-club-of-india-condemns-ed-raids-on-newsclick\"><span style=\"font-weight: 400;\">Editors Guild of India<\/span><\/a><span style=\"font-weight: 400;\"> condemned the raid and said of Newsclick: \u201c<\/span><span style=\"font-weight: 400;\">In the recent past the website has been at the frontline of reporting on the farmers agitation, the anti-CAA protests, and has been critical of various government policies and of a few powerful corporate houses,&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile a <\/span><a href=\"https:\/\/www.thehindu.com\/news\/national\/ed-searches-on-newsclick-premises-continue\/article33802700.ece\"><span style=\"font-weight: 400;\">Newsclick report<\/span><\/a><span style=\"font-weight: 400;\"> said that it has become a routine practice for the government to deploy government-controlled agencies to deal with all those who disagree with and criticise the government. In the past, the Income Tax Department, the ED, various Central investigative agencies like the Central Bureau of Investigation and National Investigation Agency, have been used against journalists, political leaders and\u00a0 farmers\u2019 leaders.<\/span><\/p>\n<h3>New digital media rules<\/h3>\n<p><span style=\"font-weight: 400;\">The government took a major step to limit the independence of digital media through the <\/span><span style=\"font-weight: 400;\">draft Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, introduced by the Ministry of Electronics and Information Technology. T<\/span><span style=\"font-weight: 400;\">he new rules seek to impose government oversight on digital news media and also prescribe a code of ethics. A committee of government officials would oversee the code\u2019s implementation and have the power to block content or order the publisher to modify or delete it.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/02\/25\/freedom-has-to-be-responsible-government-announces-new-guidelines-for-digital-media\"><span style=\"font-weight: 400;\">Editors Guild<\/span><\/a><span style=\"font-weight: 400;\"> criticised the rules which would enable the government to government to &#8220;block, delete, or modify published news anywhere in the country without judicial oversight&#8221;. The new provisions &#8220;can place unreasonable restrictions on digital news media&#8221;, the statement said. It also noted that the government did not consult with stakeholders before notifying the rules. Concerns were raised by Digipub News India Foundation, which said the rules &#8220;appear to go against the fundamental principle of news and its role in a democracy&#8221;. <\/span><span style=\"font-weight: 400;\">(For more the new Rules, see chapter xx)<\/span><\/p>\n<h3>Tweets and Facebook posts invite legal action<\/h3>\n<p><span style=\"font-weight: 400;\">The government tried its best to control media narratives over adverse episodes. To meet this objective, social media became hunting grounds to identify and control critical voices. Journalist Prashant Kanojia was arrested in August 2020 by the Uttar Pradesh police for a<\/span><a href=\"https:\/\/thewire.in\/media\/jailed-for-a-month-over-tweet-prashant-kanojia-high-court-bail-plea-to-now-come-up-after-4-weeks\"><span style=\"font-weight: 400;\"> tweet<\/span><\/a><span style=\"font-weight: 400;\"> which suggested that a right-wing leader had asked for Dalits, STs and OBCs (all marginalised castes) to not be allowed to enter the Ram Temple in Ayodhya. Kanojia was arrested on grounds of disrupting communal harmony and <\/span><a href=\"https:\/\/thewire.in\/media\/prashant-kanojia-bail-high-court\"><span style=\"font-weight: 400;\">forced to spend<\/span><\/a><span style=\"font-weight: 400;\"> two months in jail before being granted bail. \u00a0 FIRs were registered under the Information Technology Act against eight twitter handles and also the journalist Barkha Dutt\u2019s Mojo Story over tweets regarding the poisoning of three Dalit girls in <\/span><a href=\"https:\/\/www.newslaundry.com\/2021\/02\/22\/pure-intimidation-barkha-dutt-says-mojo-story-will-fight-fir-over-unnao-coverage\"><span style=\"font-weight: 400;\">Unnao<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0 The FIR against Mojo Story was on the grounds of false reporting.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The police <\/span><a href=\"https:\/\/scroll.in\/latest\/990547\/sc-quashes-fir-against-journalist-patricia-mukhim-for-facebook-post-on-conflict-between-communities\"><span style=\"font-weight: 400;\">registered<\/span><\/a><span style=\"font-weight: 400;\"> a criminal case against the editor of <\/span><i><span style=\"font-weight: 400;\">Shillong Times<\/span><\/i><span style=\"font-weight: 400;\">, Patricia Mukhim, for a Facebook post where she criticised inaction over an incident where a group of tribal boys attacked non-tribal ones in Meghalaya. The case which was registered under various IPC sections for promoting enmity between different groups, was quashed by the Supreme Court.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kashmiri journalist and editor of Kashmiriyat Qazi Shibli who was earlier detained in prison under the Public Safety Act for tweeting an official order on the movement of paramilitary troops was released in April 2020. An arrest warrant was issued by a court in Gujarat against the journalist Paranjoy Guha Thakurta, in a defamation suit filed by the Adani Group. The suit was filed by the Adani Group following a 2017 article by the journalist which accused the Narendra Modi government of tweaking rules related to special economic zones which benefitted the group financially.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A former <\/span><a href=\"https:\/\/mronline.org\/2018\/09\/12\/what-makes-an-urban-naxal\/\"><span style=\"font-weight: 400;\">editorial consultant<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><i><span style=\"font-weight: 400;\">Economic and Political Weekly<\/span><\/i><span style=\"font-weight: 400;\">, Gautam Navlakha continued to <\/span><a href=\"https:\/\/www.thehindu.com\/news\/national\/gautam-navlakha-surrenders-before-nia-in-bhima-koregaon-case\/article31338641.ece\"><span style=\"font-weight: 400;\">be targeted by the NIA<\/span><\/a><span style=\"font-weight: 400;\"> for his supposed involvement in the Bhima Koregaon violence of 2018. The Bhima Koregaon case has been used to target widely regarded human rights activists, lawyers and intellectuals by linking them to the Maoist movement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the BJP government at the centre and in states went after journalists, non-BJP state governments too acted against journalists. <\/span><a href=\"https:\/\/cpj.org\/2020\/11\/maharashtra-police-arrest-republic-tv-anchor-arnab-goswami\/\"><span style=\"font-weight: 400;\">Arnab Goswami<\/span><\/a><span style=\"font-weight: 400;\">, editor in chief of Republic TV, a news channel known to be close to the BJP was arrested by the Maharashtra Police on charges of abetment to suicide. An alliance of non-BJP Parties is in power in Maharashtra. Goswami was also investigated for inciting communal tension on Republic TV.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another colonial era law, the <\/span><a href=\"https:\/\/www.thehindu.com\/news\/national\/arrested-scribe-rajeev-sharma-was-passing-info-on-border-strategy-to-chinese-intelligence-police\/article32648112.ece\"><span style=\"font-weight: 400;\">Official Secrets Act<\/span><\/a><span style=\"font-weight: 400;\"> was used to arrest freelance journalist Rajeev Sharma in September 2020 for allegedly passing sensitive information to Chinese intelligence.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Overall, the year 2020-2021 was a dangerous one for Indian journalists who were frequently targeted by the government through a range of legal provisions. Journalists remained unsafe everywhere- whether on the streets while reporting, or inside police stations in <\/span><a href=\"https:\/\/www.ifj.org\/media-centre\/news\/detail\/category\/press-releases\/article\/india-journalists-attacked-in-uttarakhand-and-uttar-pradesh.html\"><span style=\"font-weight: 400;\">Uttar Pradesh<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/scroll.in\/latest\/976081\/attack-on-the-caravan-journalist-press-club-says-police-officer-must-be-suspended\"><span style=\"font-weight: 400;\">Delhi<\/span><\/a><span style=\"font-weight: 400;\"> where they were assaulted and mistreated. In cases where the law could have come to the aid of journalists, as in the case of the three journalists \u2013 including one woman \u2013 from the <\/span><i><span style=\"font-weight: 400;\">Caravan<\/span><\/i><span style=\"font-weight: 400;\">, who were attacked by a Delhi mob while reporting on communal tensions &#8211; the police <\/span><a href=\"https:\/\/caravanmagazine.in\/crime\/delhi-police-flouts-nhrc-order-to-file-report-on-attack-on-caravan-journalists\"><span style=\"font-weight: 400;\">dragged their feet<\/span><\/a><span style=\"font-weight: 400;\"> in filing FIRs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the<\/span><b> Maldives<\/b><span style=\"font-weight: 400;\">, blasphemy laws have been used to\u00a0 intimidate and penalise bloggers and dissenting voices. The law prohibits public statements that are contrary to Islam and violators face penalties ranging from two to five years in prison or house arrest. Impunity reigns and justice is still elusive for the murder of blogger Yameen Rashid in April 2017.\u00a0 Rasheed was active in campaigning over the disappearance of Ahmed Rilwan in August 2014. The government continued with the dissolution of the Maldivian Democratic Network in 2019, after accusations that the organisation insulted Prophet Mohammed in a report published in 2016, which was later retracted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The tourism dependant country has tried several measures to encourage tourists to visit, despite the Covid-19 pandemic, including offering vaccinations and vacations for visiting tourists. From January 2021, the government cited the pandemic to curb any protests by the opposition and arrested oppostion leaders for alleged violation of the Freedom of Peaceful Assembly Act<\/span><b>. <\/b><span style=\"font-weight: 400;\">The protestors were demanding more information on the vaccines donated by the government of India.<\/span><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In November 2020, the Maldives Parliament rejected amendments to the Freedom of Peaceful Assembly Act, which would allow protests in capital Mal\u00e9 without\u00a0 prior permission. In February 2021,<\/span><span style=\"font-weight: 400;\"> the Maldives Police <\/span><a href=\"https:\/\/www.ifj.org\/media-centre\/news\/detail\/category\/press-releases\/article\/maldives-channel-13-media-workers-harassed-during-opposition-led-protest.html\"><span style=\"font-weight: 400;\">attacked<\/span><\/a><span style=\"font-weight: 400;\"> a Channel 13 camera operator and harassed the channel\u2019s chief operating officer and station deputy in two separate incidents during opposition-led protests in Mal\u00e9.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In March 2021, the Maldives National Defense Force (MNDF) issued an advisory to warn against sharing any reports or documents on the controversial Uthuru Thila Falhu (UTF) Harbor Development Project agreement with India, which had drawn protests from citizens over whether it amounted to a foreign base. The MNDF advisory warned against any news that would \u2018hinder Maldives&#8217; relationships with neighboring countries.\u2019<\/span><\/p>\n<p><b>Nepal\u2019s<\/b><span style=\"font-weight: 400;\"> proposed <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2020\/01\/nepal-information-technology-bill-threatens-freedom-of-expression\/\"><span style=\"font-weight: 400;\">Information Technology Bill<\/span><\/a><span style=\"font-weight: 400;\"> empowers the government to arbitrarily censor content online, including on social media, and punish offenders with imprisonment and a fine.<\/span><span style=\"font-weight: 400;\"> Along with the proposed Media Council Bill, Mass Communications Bill, the <\/span><a href=\"https:\/\/www.hrw.org\/news\/2020\/05\/29\/nepal-amend-intrusive-intelligence-bill-0\"><span style=\"font-weight: 400;\">new bills<\/span><\/a><span style=\"font-weight: 400;\"> would significantly affect media freedom in Nepal. The bills are being <\/span><a href=\"https:\/\/kathmandupost.com\/national\/2021\/04\/08\/amnesty-international-paints-bleak-picture-of-rights-situation-in-nepal\"><span style=\"font-weight: 400;\">considered<\/span><\/a><span style=\"font-weight: 400;\"> by Nepal\u2019s Parliament. <\/span><a href=\"https:\/\/monitor.civicus.org\/updates\/2020\/07\/03\/protests-nepal-around-covid-19-met-excessive-force-while-journalists-face-attacks\/\"><span style=\"font-weight: 400;\">The Electronic Transaction Act<\/span><\/a><span style=\"font-weight: 400;\"> has been used to target journalists, especially those who went online with their criticism of the government during the pandemic.\u00a0<\/span><\/p>\n<p><b>In Pakistan,<\/b><span style=\"font-weight: 400;\"> journalists continue to operate in a dangerous environment. The Pakistan Electronic Crimes Act (PECA) passed in 2016 has been criticised for stifling free speech. The act criminalises speech on the grounds of blasphemy and also speech critical of state institutions. Social media activity is also under the purview of PECA. FIRs were lodged against journalists for posting \u2018negative propaganda\u2019 against the Army and state institutions and for \u2018objectionable material\u2019 on social media.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the Act, authorities can block or remove online content and file charges under criminal defamation. In the month of September 2020 alone, three Pakistani journalists were <\/span><a href=\"https:\/\/www.ifj.org\/media-centre\/news\/detail\/category\/press-releases\/article\/pakistan-three-journalists-face-sedition-charges-under-cybercrime-law.html\"><span style=\"font-weight: 400;\">charged with sedition<\/span><\/a><span style=\"font-weight: 400;\"> on the PECA law. <\/span><span style=\"font-weight: 400;\">The newspaper <\/span><i><span style=\"font-weight: 400;\">Dawn<\/span><\/i><span style=\"font-weight: 400;\"> remarked in an editorial, \u201cIt is the most sinister cybercrime legislation in the country as it goes beyond just computer-related crimes and gives authorities the licence to criminalise, restrict and prosecute free speech.<\/span><span style=\"font-weight: 400;\"> Not only does it restrict freedom of expression online, it is now increasingly being used to attempt to jail journalists.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November 2020, the government notified the the <\/span><span style=\"font-weight: 400;\">Removal and Blocking of Unlawful Online Content (Procedure, Oversight and Safeguards) <\/span><a href=\"https:\/\/www.pta.gov.pk\/assets\/media\/notification_sro_18112020.pdf\"><span style=\"font-weight: 400;\">Rules<\/span><\/a><span style=\"font-weight: 400;\"> 2020 under the PECA law. The rules make it an offense to <\/span><a href=\"https:\/\/www.dawn.com\/news\/1591732\"><span style=\"font-weight: 400;\">intimidate or harm<\/span><\/a><span style=\"font-weight: 400;\"> the reputation of government officials or induce hatred or contempt for the federal or provincial governments. The rules also incorporate Pakistan\u2019s blasphemy laws and impose stringent content regulation guidelines. Essentially meant to censor online content, the rules apply to not just content producers but also social media companies and internet service providers. It affects critics of the government, opposition parties, human rights defenders and journalists.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pakistan\u2019s journalists also <\/span><a href=\"https:\/\/www.dawn.com\/news\/1589958\"><span style=\"font-weight: 400;\">face action<\/span><\/a><span style=\"font-weight: 400;\"> from the Anti-Terrorism Act and several sections of the Pakistan Penal Code, and defamation laws.<\/span><\/p>\n<p><b>Sri Lanka <\/b><span style=\"font-weight: 400;\">amended its Press Council Law to include the regulation of electronic and new media. Sri Lanka\u2019s Criminal Investigation Department (CID) was used <\/span><a href=\"https:\/\/www.ifj.org\/media-centre\/news\/detail\/category\/press-releases\/article\/sri-lanka-journalists-interrogated-by-police.html\"><span style=\"font-weight: 400;\">to interrogate and summon<\/span><\/a><span style=\"font-weight: 400;\"> journalists. It was also used to<\/span><a href=\"https:\/\/www.hrw.org\/node\/375572\/printable\/print\"><span style=\"font-weight: 400;\"> target<\/span><\/a><span style=\"font-weight: 400;\"> the well-known journalist Dharisha Bastians, The <\/span><a href=\"https:\/\/rsf.org\/en\/news\/sri-lanka-tamil-reporter-held-absurd-terrorism-charge-0\"><span style=\"font-weight: 400;\">Prevention of Terrorism Act\u00a0 (PTA)<\/span><\/a><span style=\"font-weight: 400;\"> was invoked to arrest Murugupillai Kokulathasan a Tamil journalist for allegedly posting pictures of the LTTE leader Prabhakaran on his Facebook page. The incident is a sign of the lasting impression of Sri Lanka\u2019s civil war which ended more than a decade ago, but continues to affect civil liberties in the country . The <\/span><a href=\"https:\/\/www.ifj.org\/es\/centro-de-medios\/noticias\/detalle\/category\/press-releases\/article\/sri-lanka-tamil-journalist-arrested-for-social-media-posts.html\"><span style=\"font-weight: 400;\">PTA<\/span><\/a><span style=\"font-weight: 400;\"> has been repeatedly used to detain, arrest, assault and harass journalists and activists.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Across the region, journalists and their associations and unions have mounted spirited resistance to the onslaught of what amounts to \u201clawfare\u201d against the media. From legal challenges filed in courts, to advocacy and street protests, journalists have attempted to push for the repeal archaic and draconian colonial era laws, as well as intervene before more arbitrary bills are enacted as laws.
